I currently do not have a data plan. My plan is to add the unlimited data $15 a month to my current line, buy the Nexus One, insert the SIM card, get the phone running with my gmail account, then end the unlimited data $15 a month and use the Nexus One just with unlimited messeging, no data plan. I want to know if that will work or if at&t will recognize that I'm using a smartphone without a data plan and force me to get it.

AT&T has an IMEI database of the phone models they sell, not unlocked phones that they don't carry. It's very unlikely they'd ID the Nexus One. I'd especially not worry since you won't even be keeping the data plan that long.
